Privacy Policy

This document (“Privacy Policy”) sets out the privacy practices of Wizard Magic Pens.  This Privacy Policy is in addition to and should be read in conjunction with the terms and conditions which govern the use of any Wizard Magic Pens website and any product or service provided by Wizard Magic Pens.

Wizard Magic Pens recognises the importance of protecting  an individual’s privacy.  We know  that individuals may be concerned about what Wizard Magic Pens does with personal information provided to Wizard Magic Pens.  Wizard Magic Pens will take all reasonable steps to ensure that an individual’s personal information is protected from misuse or unauthorised disclosure.  The National Privacy Principles contained in the Privacy Act apply to Wizard Magic Pens from their introduction in December 2001.

• bank account or credit card details where an individual has provided these to Wizard Magic Pens for the purpose of acquiring good or services;

Wizard Magic Pens collects information about an individual in a number of ways, including:

• directly from the individual through our website;
• from our related companies;
• from an individual’s representatives;
• from our contractors engaged by Wizard Magic Pens to provide goods and services in the ordinary course of Wizard Magic Pens’s business;
• from customers of Wizard Magic Pens who provide information on individuals as part of any service request;
• from credit reporting agencies; and
• through the use of cookies on Wizard Magic Pens’s website.

In the event that Wizard Magic Pens is unable to collect any of the personal information, Wizard Magic Pens may be unable to provide services or information requested by the customer or an individual.

Use

Wizard Magic Pens uses personal information for the ordinary operation of its business including:

• to assist customers and their staff to use Wizard Magic Pens’s product and service;
• to provide customer with product and service they require including the administration and management of those products and services;
• for researching and developing Wizard Magic Pens’s products and services including an understanding of a customer’s communications needs for the purposes of enhancing or improving Wizard Magic Pens’s products services;
• informing Customers of changes to Wizard Magic Pens’s products and services; and
• to conduct appropriate checks regarding the provision of the products and services to a customer.

Disclosure

Wizard Magic Pens may use or disclose personal information about an individual to the extent:

• indicated at the time of supply of the information to Wizard Magic Pens;
• required to provide customers or an individual with products or services as requested;
• required for the ordinary operation of Wizard Magic Pens’s website or business (eg to inform customers about Wizard Magic Pens activities, products and services.), including:

1. provision of information to any outsource providers Wizard Magic Pens employs in the operation of its business;
2. Wizard Magic Pens’s professional advisors, including accountants, auditors and lawyers;

• necessary to undertake or provide information for credit related purposes;
• required by law; or
• expressly permitted under any agreement between Wizard Magic Pens and any customer or individual.

Wizard Magic Pens will not use or disclose any information about an individual for purposes other than those listed above without first obtaining the individual’s consent, other than where the use of disclosure is permitted by law.

Collection from third parties

If a customer or individual gives, or directs someone else to give, personal information to Wizard Magic Pens, the customer or individual will tell that other individual (“Third Party”) that:

• Wizard Magic Pens is holding personal information about that Third Party;
• such personal information will be used and disclosed as specified in this Privacy Policy; and
• the Third Party can access and  correct their information in accordance with this Privacy Policy.

Access to information

An individual may request access, changes and updates to any personal information Wizard Magic Pens hold about that individual at any time.  Where any individual wishes to access their personal information held by Wizard Magic Pens or has any complaints regarding Wizard Magic Pens’s treatment of the individual’s personal information, then please email Wizard Magic Pens at info@wizardmagicpens.com.au providing name and email address, and details of the request or complaint.

General

Wizard Magic Pens may change this policy from time to time.  Although Wizard Magic Pens intends to observe this policy at all times, it is not legally binding on Wizard Magic Pens in any way.  From time to time Wizard Magic Pens may regard it as necessary or desirable to act outside the policy.  Wizard Magic Pens may do so, subject only to any statutory rights an individual has under the Privacy Act or other applicable legislation.
